ID Theft Update: New Legislature Allows for Freeze of Credit Report
Senate Bill 222 allows consumers to obtain a freeze on their credit report simply to protect themselves from identity theft. Credit bureaus may charge up to $10 for the security freeze; however, identity theft victims are not charged. The victim is required to provide a police report. The credit bureaus may charge consumers up to $12 each time the freeze is lifted.
To take advantage of the new law, Texans must notify each of the three national credit bureaus: Experian, Equifax and TransUnion, by certified mail and include proof of their identities in the letter.

Closed Account Notification System: CANS
In 2007, the Texas Legislature passed HB 2002 in an effort to assist consumers who are subject to identity theft and fraud on their accounts.
In order to invoke rights under this law, a credit union member must close an account due to fraud. The member must provide: 1) a sworn statement that s/he is a victim of a fraud/ID theft, 2) a written authorization for the credit union to submit the necessary information to the electronic notification system, and 3) a copy of the police report (or police case or offense number). The Department of Banking developed a model form which covers the sworn statement and written authorization requirements.
